Residents have rights and the rights of residents are just as powerful as human rights or the bill of rights. Federal law governs long term care resident's rights sometimes referred to as resident's bill of rights. Federal law governs resident's rights in all long term care facilities (nursing homes, adult family homes, assisted living facilities (boarding homes) and veterans' homes. Without resident's rights in long term care facilities there would be much more abuse, neglect and poor care. Resident's rights in nursing homes, adult family homes, boarding homes and veteran's homes protect the residents' health, safety, and welfare.
Our society owes every long term care resident quality of life and care that allows him or her to live safely and with dignity. Unfortunately, resident/elder abuse, a term that encompasses physical and emotional mistreatment by caretakers; fraud and financial exploitation by relatives, brokers, and salespersons; and long term care abuse and neglect is far too common. Resident/Elder abuse can occur when the victim resides in a nursing home, assisted living facility and/or adult family home, but it may also occur when a person is living at home.
By definition, long term care neglect is when a long term care employee, either through action or inaction, deprives a resident of care preventing them from maintaining physical and mental health. Neglect can lead to even more serious conditions such as actual physical abuse. The definition of physical abuse is inflicting bodily harm intentionally such as slapping, pinching, pulling, shoving, or inappropriate use of physical or drug induced restraints. Other conditions closely related to neglect are exploitation, abandonment, emotional abuse, mental mistreatment, and sexual abuse. Sometimes neglect and abuse can unfortunately lead to wrongful death.
